Phlox Incorporated has written an Acceptable Use Policy (AUP) to
give our customers and users a clear understanding of what Phlox Incorporated
does and does not permit in the use of our services.
The following are intended as a basic
clarification of the Acceptable Use Policy (AUP) of Phlox Incorporated
With its AUP, Phlox Incorporated seeks to:
- Provide reliable
service to our customers
- Protect the security and privacy of our
systems and network as well as that of the networks and systems of
others.
- Comply with any existing laws
- Continue to function as
a responsible service provider.
- Promote responsible use of the Internet and prevent activities
that interfere with the value and utilization of Internet services.
- Maintain the use of the Internet
resources for exchange of ideas and free expression.
- Protect the privacy and security of all users.
It is the goal of
Phlox Incorporated to deliver to its customers the full resources of the
Internet. Phlox Incorporated stands behind the principles of free speech
and does not police Subscriber activities, web site content, or
newsgroups, but understands that certain activities are damaging to
both Phlox Incorporated and the Internet; therefore these activities must
not be permitted under the claim to freedom of speech. If we
feel that any material may be illegal or subject us to liability, we
may remove it.
The abuse of the resources of Phlox Incorporated
and Internet by one user has a negative effect on the entire
community. Any violation of Phlox Incorporated's AUP or TOS may result in the termination of Subscriber's account.
Phlox Incorporated
does not regularly monitor the activities of accounts, except for
routine measurements of system utilization and billing preparations.
If we become aware of inappropriate use of our services, we will take
action on the accounts. . Use of your dedicated rack or
virtual site to publish material that is indecent, unlawful, or
objectionable is prohibited by Phlox Incorporated "Material"
is defined as all forms of communications, such as narrative
descriptions, graphics (photographs, illustrations, images, drawings,
and logos), executable programs, video recordings, and audio
recordings.
Phlox Incorporated reserves the right to terminate any
account that violates our AUP or TOS.
At our option, we will advise our customers of inappropriate use of
an account and what corrective actions must be taken. However,
serious violations of the AUP will result in immediate termination of
service without notice.
Phlox Incorporated expects our customers to use
Internet access responsibly. Any questions about this
policy can be answered at abuse@Phloxinc.us.
VIOLATIONS
OF Phlox Incorporated ACCEPTABLE USE POLICY
Third Party
Accountability:
Phlox Incorporated subscribers are responsible for
any actions by third parties using their accounts that violate this
AUP. This includes friends, family members, guests, and
employees.
Your password provides access to your account.
Take care to insure that others do not gain unauthorized access to
your account by safeguarding your password. Do not share
your password with unauthorized users.
Illegal use:
Phlox Incorporated services are not to be used for illegal activities.
Phlox Incorporated will cooperate with any legal authorities and injured third
parties who are investigating any suspected crimes or civil
wrongdoings.
Harm to minors:
Use of the Phlox Incorporated
service to harm, or attempt to harm, minors in any way, including,
but not limited to child pornography, is strictly
forbidden..
Threats:
The Phlox Incorporated service may not be
used to transmit any material (by e-mail, uploading, posting or
otherwise) that threatens or encourages bodily harm or destruction of
property.
Harassment:
Use of the Phlox Incorporated service to
transmit any material (by e-mail, uploading, posting or otherwise)
that harasses another is prohibited..
Fraudulent
activity:
The use of Phlox Incorporated service to make fraudulent
offers to sell or buy products, items, or services, or to advance any
type of financial scam such as "pyramid schemes," "Ponzi
schemes," and "chain letters" is prohibited.
Forgery
or impersonation:
Adding, removing or modifying identifying
network header information in an effort to deceive or mislead is
prohibited. Attempting to impersonate any person by using forged
headers or other identifying information is prohibited; however, the
use of anonymous remailers or nicknames does not constitute
impersonation.
Unsolicited commercial e-mail / Unsolicited
bulk e-mail (Spam)
The use of the Phlox Incorporated service to transmit
any unsolicited commercial or unsolicited bulk e-mail (Spam) is
expressly prohibited. Violations of this type will result in the
immediate termination of the offending Phlox Incorporated account.
IMPORTANT
NOTICE:
Any Subscriber hosting websites or services on their
server that support Spammers or cause any of our IP space to be
listed in any of the various Spam Databases will have their server
immediately removed from our network. The server will not be
reconnected until you remove any traces of the offending material
immediately upon reconnection and agree to allow us access to the
server to confirm that all material has been completely removed. Any
server guilty of a second violation will be immediately and
permanently removed from our network without notice.
E-mail /
News Bombing.
Any attempt to impede someone else's use of
E-mail services or news will result in the immediate termination of
the offender's Phlox Incorporated account.
E-mail / Message Forging:
Forging any message header, in part or whole, of any
electronic transmission, originating or passing through the Phlox Incorporated
service is prohibited..
Usenet Spamming:
Posting any
messages or commercial advertisements through the Phlox Incorporated network
in violation of the rules of any newsgroup or mailing list is
strictly forbidden. Commercial messages that comply with the
rules of a newsgroup or mailing list are exempt.
Unauthorized
access:
Using the Phlox Incorporated service to access or make an
attempt to access the accounts of other users is prohibited.
Breaking into or attempting to break into Phlox Incorporated's
security or the security measures of any other computer software or
hardware, electronic communications system, or telecommunications
system is forbidden. Whether or not your attempts were
successful, your Phlox Incorporated account will be immediately
terminated.
Copyright or trademark infringement:
Using
the Phlox Incorporated service to violate the copyrights of third parties is
prohibited. This means you may not transmit by any means the
copyrighted material of any third party without the written
permission of that third party. Copyrighted material includes
patents, trade secrets, or intellectual property rights.
Collection of personal data:
You may not use the
Phlox Incorporated service to collect any personal information of any third
party without the permission of that third party.
Network
disruptions and unfriendly activity:
You may not use the
Phlox Incorporated service for actions which affect the ability of other people
or systems to use Phlox Incorporated services or the Internet. It is your
responsibility to configure your network in a secure manner.
You may not allow others to use their network for any illegal
actions. Use of your network for unauthorized entry and/or use
of another individual's or company's computer system will result in
immediate termination of your account.
Fraud:
Fraud is
defined as using misleading statements to deceive the person
receiving the statements. The use of Phlox Incorporated's services for
fraudulent activity is expressly forbidden.
Distribution of
Viruses:
You are prohibited from intentionally distributing
software that causes or attempts to cause damage or annoyance to
persons, data, or computer systems. Subscribers who
distribute such software (viruses) will have their accounts
immediately terminated.
IRC networks:
Phlox Incorporated
prohibits the hosting of an IRC server that is part of or
connected to another IRC network or server. Any server
connected to or part of these networks will be removed from our
network. Your server will not be reconnected to the network
until you agree to completely remove all traces of the IRC server.
You must then agree to give us access to your server to check
that the content is completely gone. A second violation of this
policy will result in immediate account termination. Security
Do
not attempt to violate the security of any host, network, or
account. You must not access data not intended for you, log
into a server or account your are not authorized to access, or probe
the security of other networks. Do not use tools designed to
circumvent security, such as password guessing programs, cracking
tools, or network probing tools.
Users who violate systems or
network security risk criminal or civil liability. Phlox Incorporated
will cooperate in the investigations of systems or networks at
other sites.
Network Performance
Your Phlox Incorporated account
operates on shared resources. If one customer uses the shared
network excessively or abuses the shared network, there may be a
negative impact on all customers. If you misuse the network
resources by impairing the network performance, your account may
be terminated.
Excessive consumption of resources, including
disk space, CPU time, session time, and memory is prohibited.
Do not use resource-intensive programs, which will have a negative
effect on other customers or the performances of Phlox Incorporated systems or
networks. Phlox Incorporated may terminate or limit such
activities.
REPORTING VIOLATIONS OF Phlox Incorporated AUP
If you
believe that there has been a violation of this AUP, please forward
the information to the Abuse Department at abuse@Phloxinc.US.
If
possible; please provide the following information to Phlox Incorporated:
The
IP address used to commit the alleged violation
The date and
time of the alleged violation, including the time zone or offset from
GMT
Evidence of the alleged violation
E-mail with
full header information provides all of the above, as do system log
files. Other situations will require different methods of providing
the above information. Phlox Incorporated may take any one or more of the
following actions in response to complaints:
Issue warnings
Suspend the Member's newsgroup posting privileges
Suspend
the Member's account
Terminate the Member's account
Bill
the Member for administrative costs and/or reactivation charges
Bring legal action to enjoin violations and/or to collect
damages, if any, caused by violations
REVISIONS TO THIS
ACCEPTABLE USE POLICY
Phlox Incorporated reserves the right to amend,
revise, and/or modify this AUP, Terms of Service (TOS),
and our other policies at any time. We will post a notice of
any revisions in accordance with our TOS.
